Terms of Service

1. Agreement to Terms

These Terms of Service ("Terms") govern your access to and use of The PreMarriage Counselor (the "Service"), including our web platform and mobile applications, provided by The Middle Shelf Holdings LLC ("we," "us," or "our"). By creating an account, accessing, or using the Service, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Service.

2. Who Can Use the Service

The Service is a professional tool for marriage and pre-marriage counselors, the organizations they work for, and the couples those counselors invite. It is used by roles:

• Organizations and Counselors — accounts are created by an organization on the web platform, or by invitation from an organization administrator. There is no public, self-service sign-up for counselor accounts.
• Couples — invited directly by their counselor via a private, emailed link to complete questionnaires. Couples do not need to install any application to use the Service.

You must be at least 18 years old to create an account or to be invited as a couple. By using the Service, you represent that you meet this requirement and that all information you provide is accurate.

3. Accounts & Security

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at support@themiddleshelf.com if you suspect unauthorized use of your account. Organization administrators are responsible for the counselor accounts they create or approve within their organization.

4. Subscriptions, Billing & No In-App Purchases

Organizations subscribe to the Service, and billing is managed entirely through our web platform. The mobile applications do not sell, display prices for, or process any purchase, subscription, or payment — they are companion apps to an organization's existing web subscription and contain no in-app purchases.

• Fees, billing cycles, and plan details are set out on the web platform at the time of purchase and may change with notice to the organization.
• Cancelling a subscription stops future billing; it does not automatically delete existing data, which remains subject to this agreement and our Privacy Policy until deletion is requested or retention periods expire.
• Refunds, where applicable, are handled case-by-case — contact support@themiddleshelf.com.

5. AI-Generated Reports Are Not Professional Advice

The Service uses artificial intelligence to help generate summaries, comparisons of a couple's answers, and suggested talking points from the information a couple submits. These AI-generated materials:

• are decision-support content intended to assist a licensed or trained counselor — they are not a diagnosis, a treatment plan, or a substitute for professional counseling, therapy, legal advice, or medical advice;
• are generated from the specific answers provided for a single request and are not the product of the AI model "learning" from, retaining, or being trained on your organization's data;
• may be incomplete, may not capture every nuance of a couple's circumstances, and should always be reviewed and applied using the counselor's own professional judgment before being relied upon or shared with a couple.

The Middle Shelf Holdings LLC is a software provider, not a counseling practice, and is not responsible for the counseling advice, decisions, or outcomes of any counselor, organization, or couple using the Service.

6. Your Content & Data Ownership

You retain ownership of the information you submit to the Service, including questionnaire answers, custom forms, and generated reports ("Your Content"). You grant us a limited license to host, process, and display Your Content solely to operate and improve the Service, as described in our Privacy Policy. A couple's answers are visible only to their assigned counselor and that counselor's organization, unless the couple or counselor chooses to share a report (for example, by email or PDF export).

7. Acceptable Use

You agree not to:

• use the Service for any unlawful purpose or in violation of any applicable law;
• attempt to access another organization's, counselor's, or couple's data without authorization;
• reverse engineer, scrape, or interfere with the operation or security of the Service;
• upload content that is fraudulent, abusive, or infringes another person's rights;
• use the Service to provide counseling services you are not qualified or licensed to provide under applicable law.

8. Intellectual Property

The Service, including its software, design, branding, and default questionnaire content, is owned by The Middle Shelf Holdings LLC and protected by intellectual property laws. Except for Your Content, nothing in these Terms grants you any right to use our trademarks, logos, or branding without our prior written consent.

9. Termination

We may suspend or terminate your access to the Service if you violate these Terms, if your organization's subscription lapses, or if required to protect the security or integrity of the Service. You may stop using the Service at any time; an organization administrator may request deletion of an organization's data as described in our Privacy Policy.

10. Disclaimers & Limitation of Liability

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. To the fullest extent permitted by law, The Middle Shelf Holdings LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, revenue, or goodwill, arising from your use of the Service or reliance on any AI-generated content it produces.

11. Changes to These Terms

We may update these Terms from time to time. We will post the revised Terms on this page and update the "Effective Date" above. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
